These Terms & Conditions (“Terms”) govern your use of the websites, mobile experiences, and text-messaging services (collectively, the “Services”) provided by Hanson Paving, Inc. (“we,” “us,” “our”). By accessing or using any of the Services you agree to these Terms and to our Privacy Policy.
1. Eligibility & Acceptance
You must be at least 18 years old (or the age of majority in your state) to use our Services. If you do not agree with these Terms, do not access or use the Services.
2. Scope of Services
We offer estimates, scheduling, and invoicing. Our services may also include email and SMS communications for customer service, project scheduling, project updates, and feedback requests. If separately consented to, we may also send promotional messages, special offers, and sales-related messages.
3. Text-Messaging Program
You may opt in to receive SMS messages from Hanson Paving LLC by submitting a website form and checking one or both optional SMS consent checkboxes. Depending on the checkbox you select, you may receive:
• non-marketing messages related to customer service, scheduling, project updates, and feedback requests; and/or
• marketing messages related to promotions, special offers, and sales-related messages.
SMS consent is not a condition of purchase. Message frequency may vary. Message & data rates may apply. Reply STOP to opt out. Mobile opt-in data and consent are not shared with third parties or affiliates for marketing purposes. We may share information with service providers that help us operate our website, texting platform, and business systems. Carriers are not liable for delayed or undelivered messages.
4. Charges & Fees
Except for SMS carrier charges, you will only be billed for services you explicitly authorize (e.g., accepted estimates, agreed subscriptions). All invoices are due per the payment terms stated on each invoice.
5. Acceptable Use
You agree not to:
• use our Services for unlawful, fraudulent, or abusive purposes;
• scrape, copy, or reverse-engineer any part of the site or software;
• upload malicious code;
• impersonate another person or misrepresent your affiliation.
6. Intellectual Property
All content, trademarks, logos, and software are owned by Hanson Paving, Inc. or its licensors. You receive a limited, non-exclusive license to access and use the Services solely for their intended purpose.
7. Disclaimer of Warranties
Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that messages, emails, or forms will be error-free, uninterrupted, or secure.
8. Limitation of Liability
To the maximum extent allowed by law, Hanson Paving, Inc. will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim related to the Services will not exceed $100 or the amount you paid us in the three months preceding the claim, whichever is greater.
9. Indemnification
You agree to defend and hold harmless Hanson Paving, Inc., its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
10. Termination
You may stop using the Services at any time. We may suspend or terminate access for violation of these Terms or any applicable law, or if required by carriers or regulatory authorities.
11. Modifications
We may update these Terms at any time. Material changes will be posted on this page with a new “Last updated” date. Continued use after changes means you accept the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Benton County, Minnesota.
